Construction Accident Fraud
A.3800 (Weprin) / S.5231 (COMRIE)
This legislation will make the staging of a construction site accident for the purposes of insurance fraud a class E felony.
New York is facing a disturbing rise in staged accidents on construction sites for the purposes of insurance fraud. These fraudulent acts have emerged as a pervasive insurance scam leading to inflated costs in construction and housing.
Staged accidents are orchestrated by organized crime syndicates that recruit or otherwise coerce desperate individuals into staging these accidents and then manipulate the insurance and legal systems to receive exorbitant settlements.
This legislation is crucial in safeguarding the integrity of our construction and insurance industries and mitigating the financial housing burden for our citizens.
Runner Legislation
Current Legislation A.7392 (Pretlow) / S.4874 (FAHY)
This bill creates the crime of unlawful procurement of clients in three degrees. Criminalizes acting as a "runner" or soliciting or employing a "runner" to procure patients or clients.
This legislation is modeled after laws in New Jersey and federal anti-kickback statutes, aiming to combat insurance fraud in New York. It targets the practice of using "runners"—individuals paid to recruit patients for fraudulent medical providers who bill no-fault insurance for unnecessary or fake treatments. The bill seeks to reduce fraud by criminalizing both runners and the providers who use them, with penalties ranging from a class A misdemeanor to class D felony, depending on the financial impact or frequency of offenses.
